These Terms of Service govern your access to and use of the WiseTip Service, including the iOS mobile application and the website at wisetip.com. By creating an account or using the Service, you confirm you are 16 or older (13 or older for users in the United States) and agree to be bound by these Terms.

The Service is operated by WiseTip Prosta Spółka Akcyjna w organizacji (Simple Joint-Stock Company in organization), ul. Ostrowska 22/3, 71-757 Szczecin, Poland. TIN: pending. Share capital: PLN 10,000. Distributed on the App Store by Martin Kmieciak (sole trader) acting as authorised distributor of the Operator. Apple Inc. is not a party to these Terms.

I. General Rules

These Terms regulate access to the Service, publication of User Content, complaints, and the rights and obligations of both parties. The Service is free to use. Processing of personal data is described in our Privacy Policy.

Automated tools (bots, scripts, scrapers) that artificially inflate the popularity of User Content or harvest data from the Service are prohibited. The supervisory authority for DSA obligations in Poland is the Office of Electronic Communications (UKE). Contact: support@wisetip.com.

II. The Service

The WiseTip app is available on the App Store for iOS 16 or later. An internet connection and an active email address are required.

The Application is licensed, not sold. The licence is non-exclusive, non-transferable, and limited to use on Apple devices in accordance with App Store usage rules. Apple Inc. is not a party to these Terms and bears no responsibility for the Application or Service.

In the event of a breach, we will send a notice with a minimum 7-day remedy period, after which we may warn, suspend, delete the account, or ban re-registration. We may take immediate action where you create legal risk, repeatedly infringe intellectual property rights, your content endangers Users, or where required by law.

III. Account and Electronic Services

Agreement: Concluded at the moment your account is created, for an indefinite period.

Right of withdrawal: As a consumer, you have 14 days to withdraw without reason. By requesting immediate access, you acknowledge the right of withdrawal is lost once the Service has been fully performed.

Account security: Keep your password confidential. Do not share your account. Your account is non-transferable.

Business claims: A company whose name or trademark corresponds to a username may contact support@wisetip.com. We will take appropriate action following verification.

Termination: Email support@wisetip.com or delete your account in the app. Full removal from backup systems takes up to 90 days. Deleted accounts cannot be restored.

IV. Newsletter

Sign-up is voluntary and requires explicit consent (opt-in). Unsubscribe anytime by emailing support@wisetip.com or using the unsubscribe link in any newsletter.

V. User Content

You publish User Content at your own responsibility and warrant you hold all necessary rights and that the content complies with these Terms.

Licence: By publishing, you grant the Operator a non-exclusive, royalty-free, worldwide, perpetual licence to host, display, reproduce, distribute, and create compilations of your content for the operation and development of the Service.

The Operator acts as a hosting provider under Art. 6 DSA and does not verify content prior to publication. The Operator reserves the right to remove or suspend content, with notification and right of appeal.

Third-party disputes: Disputes arising from User Content — including unauthorised copying or redistribution outside the Service — are solely between you and the third party. You irrevocably release the Operator from all related claims.

Indemnification: You agree to defend, indemnify, and hold harmless the Operator and its shareholders, directors, employees, and agents from all claims, liabilities, damages, and legal costs arising from: (a) breach of these Terms or applicable law; (b) User Content infringing third-party rights; (c) untruth of your representations; (d) your acts or omissions in using the Service.

VI. Reviews, Opinions and Regulated Content

Reviews must reflect genuine experience and must not be motivated by undisclosed compensation. The Service ranks content based on honesty and authenticity rather than follower count. Prohibited: undisclosed advertising, false paid recommendations, unmarked affiliate links. Violating content will be removed with a 7-day right of appeal.

a) Weapons and dangerous equipment

Reviews and tests of all types of weapons and equipment are permitted, including firearms, hunting and sport weapons, collectible weapons, bladed weapons, survival equipment, and personal defence devices — provided the user possesses and uses them lawfully. Prohibited: content depicting weapons used against humans, content suggesting or glorifying illegal use, depictions of illegally modified weapons. Hunting is a permitted activity and hunting equipment reviews are welcome. However, showing dead or injured animals is strictly prohibited in all contexts, including legal hunting. Content violating this section is removed immediately without right of appeal.

b) Nudity and sexual content

All nudity and sexual content is absolutely prohibited without exception. This includes visible nipples regardless of gender, external genitalia, uncovered buttocks, and sexually suggestive content even without full nudity. This applies to all product categories including underwear, sportswear, cosmetics, and medical devices — products must be reviewed without exposing prohibited body parts. Content violating this section is removed automatically or immediately upon detection, without prior notice and without right of appeal.

c) Alcohol and tobacco products

Reviews of all alcohol products (wine, beer, spirits, fermented beverages) and tobacco and nicotine products (cigarettes, cigars, pipes, e-cigarettes, heated tobacco, nicotine pouches) are permitted. A product review — describing personal experience and assessment — does not constitute advertising or promotion in the legal sense. Content crosses the line into prohibited promotion when it urges purchase, creates positive associations beyond product description, or targets minors. Prohibited: content linking alcohol or tobacco with driving or operating machinery.

d) Medicines, supplements and medical devices

Reviews of all legally available products are permitted, including medicines available without prescription, dietary supplements, medical devices, and medical and rehabilitation equipment. Reviews of prescription medicines are also permitted, but only in the form of a personal patient account describing the treatment experience — the content must clearly indicate the medicine was prescribed by a doctor and must not recommend its use by others.

When the Service identifies that content relates to a prescription medicine, the following notice is automatically displayed beneath the review and cannot be removed:

⚠️ This review relates to a prescription-only medicine. The experience described is the personal account of a patient and does not constitute medical advice, a diagnosis, or a recommendation to use this medicine. Always consult a doctor or pharmacist before taking any medicine.

Prohibited: content encouraging use of prescription medicines without a medical prescription; content promoting combining medicines with alcohol or other substances for recreational purposes; content facilitating purchase of medicines from illegal sources or without a prescription where one is required.

e) Psychoactive and controlled substances

Reviews of all substances that are legal in Poland and the European Union are permitted, including products containing CBD (cannabidiol) lawfully placed on the market. Reviews of illegal or controlled substances are absolutely prohibited, including narcotics, psychotropic substances, designer drugs, and any other substances prohibited under applicable law, regardless of their legal status in other jurisdictions. Content instructing how to obtain, synthesise or use illegal substances is also prohibited. Content violating this section is removed immediately and may result in permanent account termination and referral to law enforcement authorities.

VII. Video Threads

Video Threads allow public video replies to Reviews, creating asynchronous debate threads. Each reply is separate User Content governed by Section V, visible to all users. Replies may be deleted at any time.

VIII. Complaints

Submit complaints to support@wisetip.com. We respond within 21 days. No response within this period constitutes acceptance of the complaint.

IX. Liability

The Operator is liable for the technical functioning of the Service and conformity with the agreement towards consumers. We are not liable for damage caused by: false data provided by you; sharing your password; cyberattacks despite our security measures; account deletion; or technical downtime beyond our control.

X. Illegal Content and Reports

The Operator does not monitor User Content on an ongoing basis (Art. 6 DSA). Report violations via "Report abuse" or support@wisetip.com.

  • Potentially illegal content (CSAM, terrorism, incitement to violence): removed within 24 hours.
  • Other violations: decision within 14 working days.

Appeals within 7 days; we respond within 7 working days.

XI. Changes to Terms

We notify you by email at least 15 days before changes take effect. Continued use constitutes acceptance.

XII. Provisions for Non-Consumer Users

Applies only to users acting in the course of a business who are not consumers under Polish law. The Operator's liability is limited to wilful misconduct and actual documented losses, excluding lost profits. Disputes resolved by the court having jurisdiction over the Operator's seat.

XIV. Final Provisions

Governing law: Polish law. This choice does not deprive consumers of mandatory protections under their country's law.

If any provision is invalid, the remainder stays in force. Disputes with consumers may be resolved via the EU ADR platform: consumer-redress.ec.europa.eu.

These Terms, together with the Privacy Policy, constitute the entire agreement between the Operator and the User.
